Conference to deploy and thoroughly grasp Resolution No. 04/2024/NQ-HDTP of the Council of Justices of the Supreme People's Court
On the morning of July 17, 2024, Mr. Nguyen Tien Hai, Member of the Party Central Committee, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council and Mr. Le Van Su, Vice-Chairman of the Provincial People's Committee, chaired an online conference to deploy and thoroughly grasp Resolution No. 04/2024/NQ-HDTP of the Council of Justices of the Supreme People's Court. More than 3,800 delegates representing party committees, authorities, and unions at all levels at 3-level bridge points in the province attended the conference.

Conference to deploy and thoroughly grasp Resolution No. 04/2024/NQ-HDTP dated June 12, 2024 of the Judicial Council of the Supreme People’s Court (Resolution 04/2024/NQ-HDTP) on instructions for applying a number of provisions of the Penal Code on criminal prosecution for acts related to illegal exploitation, trading, and transportation of aquatic products. Resolution 04/2024/NQ-HDTP includes 11 Articles, this is the legal basis for agencies to conduct proceedings to strictly handle cases of illegal exploitation, trading and transportation of aquatic products. Specifically, the authorities will pursue criminal liability for acts of leaving the country to illegally exploit fishery products outside Vietnam's waters; Organizing and brokering entry and exit for others to bring fishing vessels and fishermen to illegally exploit foreign waters. Fishery exploitation activities violate regulations on protection of aquatic resources; exploiting, trading, and transporting endangered, precious, and rare aquatic products; smuggling, illegally transporting seafood, using deceitful tricks to buy and sell seafood. Investigate criminal liability of foreigners for the act of sending fishing vessels to illegally exploit aquatic products occurring on the Vietnamese coast.
Notably, when people violate regulations on management and use of fishing vessel monitoring equipment for illegal fishing; forging seals or documents of agencies or organizations or using fake seals or documents of state agencies to illegally exploit, buy, sell or transport aquatic products will be prosecuted. The Resolution 04/2024/NQ-HDTP takes implementation effect as from August 1, 2024.

Speaking at the conference, Mr. Nguyen Tien Hai, Member of the Party Central Committee, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council, directed Party committees, organizations, authorities, Fatherland Front Committee, socio-political organizations at all levels, especially leaders, to thoroughly grasp, seriously and effectively implement regulations, guiding documents of the Central and provincial governments related to this work. Especially propagandizing and directing the implementation of Directive No. 32-CT/TW, dated April 10, 2024 of the Party Central Committee Secretariat on strengthening the Party's leadership in combating illegal, unreported and unregulated (IUU) fishing and sustainable development of the fisheries industry; Resolution No. 04/2024/NQ-HDTP of the Council of Justices of the Supreme People's Court; Directive No. 17-CT/TU, dated February 26, 2024 of the Provincial Party Standing Committee on strengthening the leadership and direction of Party Committees and authorities at all levels regarding destructive exploitation of aquatic resources exterminated in the province. Strengthen leadership, direct propaganda, and widely disseminate to each household about groups of illegal exploitation, trading, and transportation of aquatic products that are subject to criminal prosecution.
The Provincial Border Guard Party Committee leads and directs Border Guard Stations and Fleets to tighten the management of entering and exiting into the seaport, ensuring that 100% of incoming and outgoing ships must pass through strict control. Coordinate with the Department of Agriculture and Rural Development to maximize the fishing vessel monitoring system. Assign technical staff to closely monitor and supervise 24/7. In case of the vessels monitoring system loses their signal at sea for a duration exceeding prescribed time and the ship owner or captain does not notify, the records and documents will be consolidated and handled strictly in accordance with the provisions of law. The Provincial Police Party Committee leads and directs the Police force to proactively deploy professional measures, closely grasp the situation, promptly detect, fight, prevent, and strictly handle acts of illegally leaving the country or organizing or brokering for others to flee abroad or stay abroad illegally for the purpose of illegal fishing in foreign waters. Proactively manage and grasp the situation and actively handle IUU fishing and destructive fishing practices.
The Party Committee of the Provincial People's Court and the Party Committee of the Provincial People's Procuracy continue to disseminate, deploy and provide professional guidance to the Court force and People's Procuracy at 02 levels in the province, ensuring Expertise and consistency in handling violations. Minimize the possibility that litigation agencies have different views in handling violations. At the same time, direct the selection of a number of cases to be brought to trial on a mobile basis, creating widespread awareness among the people.
Mr. Nguyen Tien Hai, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council, requested the Standing Party Committees of districts and city Party Committees to lead and direct the District People's Committee to coordinate with relevant departments, branches, and units to review and finalize list the number of fishing vessels; compare with regulations and records of fishing vessels registered and managed to ensure compliance with regulations. In any locality with loose management, the Secretary and Chairman of the District and Commune People's Committees are responsible to the Provincial Party Secretary and Chairman of the Provincial People's Committee. The Provincial Party Committee's Propaganda Department and the Department of Information and Communications orient and guide newspapers, radio and media agencies to promote extensive propaganda work among the people, especially fishermen, helping to improve understanding of the law, contributing to good implementation of the work against IUU fishing; combat destructive exploitation of aquatic resources and illegal exploitation, trading, and transportation of aquatic products in the province.
